Last Will and Testament of Philip Phillips

Written 26 March 1837, Proved 30 May 1838

This is the last will and testament of me, Philip Phillips, of lot no. fifty-three in the first concession of the township of Markham home district wherein I dispose of my wordly affects as follows:

      To my beloved wife Rachel, I give during the time of her natural life, the seventy acres of the north half of my farm, lot fifty-three - first concession in the township of Markham, measuring from Yonge Street, with all the buildings thereon - to use as she pleases - and all my household furniture - plate, linen, bed and bedding - books - glass - china - crockery ware - clocks - watches - saddles - bridles - my pleasure waggon and harness - all my horses, cattle, sheep and pigs - I give to her absolutely & forever, to do as she pleases with - and immediately after the decease of my said beloved wife Rachel, the aforesaid seventy acres (see plan on the last sheet of this my will) shall be sold by public sale or private contract, as shall seem best to my executors, hereafter named, and the money arising from such sale, shall be divided as follows, to my daughters - Sarah Selby - Mary Varnum - Anne Catherine Arnold - and my sons - William - Isaac and my adopted son Isaac J.C.L. Phillips - each one-eighth part, and to my son Phillip two-eighths parts.

      To my youngest son Isaac, I give ninety acres - being part of my farm aforesaid, situated in the first concession in the township of Markham, and lot no. fifty-three, which ninety acres are marked on the plan in the last sheet of this my last will & testament, with the buildings thereon, forever to do with as he pleases.

      My farm, lot no. two in the first concession of the township of King, containing about one-hundred & eighty acres, I desire shall be divided into two equal parts, as near as can be, by dividing the northern & southern boundaries into two equal parts, and the part of half next to Yonge Street (the street now used), I give to my daughter Anne Catherine Arnold & her husband Louis Arnold during their natural lives - or the life of the survivor of them, for their use & support and after their decease to any child, or children my said daughter Anne Catherine may have - but should she die without issue, then after the decease of herself and husband the aforesaid half, ninety acres (more or less) with the buildings thereon, being the half of lot no. two, in the first concession of the township of King, and next to Yonge Street, as aforesaid, I give & bequeath to my adopted son, Isaac J.C.L. Phillips, forever, to do as he pleases with - and the other half of lot no. two in the first concession, of the township of King, being the westerly half, to my son William & his wife Anne Cevillah, shall have the free use of, with the buildings thereon during their natural lives, or the life of the survivor of them, and at their decease the aforesaid westerly half shall be divided share & share alike, among their children, or sold & the money arising from such sale shall be equally divided among them - as now named - Lavinia - Rebecca - Rachel - William - Mahlon - Philip - Elias - Samuel - Eliza Ann & Anne Cevillah, and all the other children that may be born to my said son William during his life, or in due time after his decease. For the divisions of my lands see plans on the other side of this sheet.

      And I hereby nominate and appoint my beloved wife Rachel, and my nephews, Owen Phillips and Gideon Phillips, my executors to carry into effect this my will, consisting of three sheets of paper, this twenty-sixth day of March in the year of our Lord, one-thousand-eight-hundred - thirty-seven.
