The Will of Wait Hatch

 
"In the name of God, Amen. I Waite Hatch of Hebron in the County of Washington and State of New York do make and declare this my last will and testament, in the manner and form following:
"First- I resign my soul into the hands of Almighty God, hoping and believing in a remission of my sins, by the merits and mediation of Jesus Christ. And my body I commit to the earth, to be decently buried at the discretion of my Executors hereinafter named. And my worldly estate I give and give and devise as follows-

    "Item - I give and bequeath to my beloved wife Martha Hatch all my real and personal estate that I may have at my decease, after my debts are all paid: during her natural life, providing that she shall remain a widow and unmarried, but in case that she shall at any time marry, my further will is that she shall have in lieu of all dower only one third of my said real and personal estate, during her said natural life.
    "Item - I further will and ordain that in case my said wife shall at any time after my decease marry again, then, in that case both my real and personal estate shall be sold at private or public sale to the best advantage that can be obtained and the avails be applied and paid out as is hereinafter directed (excepting what is herein before disposed of to my said wife during her natural life as aforesaid)
    "Item - I also further will and ordain that at the decease of my said wife all my real and personal estate shall be sold in the manner and ways aforesaid and the avails thereof applied and paid out as aforesaid
    "Item - In case that either of the above contingencies shall happen, I give and bequeath to John Hatch, my son, the sum of three hundred dollars out of the avails of my estate sold as aforesaid
    "Item - I also give and bequeath to my son Eli Hatch the sum of three hundred dollars to be paid to him either at my said wife's marriage or decease whenever the same shall happen
    "Item - I give and bequeath the sum of two hundred and twenty five dollars to Jeremiah Hatch, my son, to be paid to him at the time the above mentioned contingencies may take place last aforesaid
    "Item - I give and bequeath to my five daughters Elmina Ayers, Lydia Brown, Mary Wheeden, Sarah Hatch and Phebe Hatch, the sum of one hundred dollars each - providing that after paying my said three sons their said legacies as is above specified there shall be property enough left sufficient to pay the same - but in case there is not property sufficient to pay the said hundred dollars to each of my said daughters - then in that case whatever shall remain, if any, shall be divided between them equally, share and share alike
    "Item - My further will is that after paying all my debts and the above mentioned legacies, if any of the avails of my said estate - effects or property then should be left or remain - the same shall be divided amongst my then surviving children equally - share and share alike
    "Item - I hereby constitute and appoint Martha Hatch, my wife, and Levi Hatch my son sole Executrix and Executor of this my last will and testament.

"We the undersigned have, at the request of Wait Hatch the subscriber to this snstrument, purporting to be his last will and testament, and so declared by him to us in his presence and in the presence of each other subscribed our names as Witnesses to the Execution of the same by him.
